Agreement

These Terms of Service govern your access to and use of Sendflit websites, software, APIs, and related services.

Eligibility and accounts

You must be legally capable of entering into a binding agreement and use Sendflit only in compliance with applicable laws.

You are responsible for maintaining account credentials, controlling account access, and all activities that occur under your account.

Services and acceptable use

You may use Sendflit only for lawful business purposes. You must not misuse the services, attempt unauthorized access, interfere with platform operations, or transmit malware.

We may enforce usage limits, rate limits, and technical safeguards to protect platform stability and security.

Customer content and data

You retain ownership of your content and data. You grant Sendflit the limited rights necessary to host, process, transmit, and display such data solely to provide and maintain the services.

You represent that you have all required rights and permissions for data you submit through Sendflit.

Email compliance and anti-spam

You are solely responsible for compliance with anti-spam and electronic communications laws, including consent, sender identification, and unsubscribe obligations.

You must not send unsolicited bulk messages, deceptive content, or prohibited campaigns through Sendflit.

Fees and billing

Paid plans are billed according to your selected subscription and usage. You authorize Sendflit and its payment processors to charge applicable fees, taxes, and renewals.

Unless otherwise required by law, fees are non-refundable. We may update pricing with reasonable prior notice.

Intellectual property

Sendflit and its licensors retain all rights, title, and interest in the services, software, documentation, trademarks, and related intellectual property.

Except as expressly allowed in these Terms, no rights are granted to you by implication or otherwise.

Third-party services

The services may integrate with third-party tools, networks, or providers. Sendflit is not responsible for third-party products, content, or policies.

Your use of third-party services is governed by your agreements with those providers.

Confidentiality

Each party may receive confidential information from the other. The receiving party will protect such information with reasonable care and use it only as needed to perform under these Terms.

Confidentiality obligations do not apply to information that is public, independently developed, or lawfully received without restriction.

Suspension and termination

We may suspend or terminate access if you violate these Terms, create legal or security risk, or fail to pay fees when due.

You may stop using the services at any time. Certain obligations survive termination, including payment, confidentiality, and liability limitations.

Disclaimers

Sendflit is provided on an "as is" and "as available" basis. To the maximum extent allowed by law, we disclaim implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted or error-free service.

Limitation of liability

To the fullest extent permitted by law, Sendflit and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, goodwill, or data.

Our aggregate liability for claims arising out of or related to the services is limited to amounts you paid to Sendflit in the twelve months before the event giving rise to liability.

Indemnification

You agree to defend, indemnify, and hold harmless Sendflit and its affiliates from claims, liabilities, damages, and expenses arising from your use of the services, your content, or your violation of these Terms or applicable law.

Governing law

These Terms are governed by applicable laws specified in your order form or, if none is specified, by the laws of the jurisdiction where Sendflit is established, without regard to conflict-of-law principles.

Changes

We may revise these Terms from time to time. If changes are material, we will provide notice through the website, account dashboard, or other reasonable channels.

By continuing to use the services after updated Terms become effective, you agree to the revised Terms.
